you shouldn't be locked at 70hz, if you go to your advanced adaptor settings and list all modes your saying there are no 60hz options on the list?

Yes there is an option for 60hz but it carries considerable amount of video lag. Is not the best option for most modern 3d games. I have ran it before but it does act weird when switching resolutions for games and such and sometimes causes me to turn the tv off then on again. So I have everything set up for 720p resolution and set for 70hz with no problems but this one game.

No. The option was available with the install of the DVI+Toslink to HDMI adapter. The 60hz was custom.
I should add custom for 720p. 1080p it is the default but the lag is definantly present in 1080p over 720p so 720p is what I use (try to) for everything. Better display for someone as blind as me (TV across the room not tiny monitor in your face) and smoother for game play.

I've done some testing with odd refresh rates and I can recreate the issue in some cases. However, I don't get any stuttering when v-sync is disabled.

i can not reproduce this issue on my system, i've added a 720p mode at 70hz and it runs normally (vsync on and off)

I've done some testing with odd refresh rates and I can recreate the issue in some cases. However, I don't get any stuttering when v-sync is disabled. David Disabled in game and in Nvidia control panel? What are your control panel settings if you wouldn't mind.

I using AMD for GFX with all thigns default. Are you forcing v-sync in the drivers then?

This is known and the screen will fall back to driver recommended hz settings. This hasn't been possible since Windows XP so I suppose if you are using XP then maybe you can run a fullscreen 3d app with custom hz setting.

This problem I am having here has been going on since I first found out about Phase Shift back in August I think. I just figured I would wait to see if it was fixed with a new release. The note road is the only issue I have. The game runs great and like I said if the limiter has it pegged at 60fps then you really can't ask for a better experience. I am not one to complain at all here guys. I am quite OCD about this rig and keep this machine well maintained. I have no other issues with other games or applications and even have my own MSVC developer environment on this system. I really wouldn't have posted if I didn't feel like I have exhausted all other options.

If your display does not report the custom hz you have configured then it will not use it for full screen. It has to be reported by the displays driver. Sucks I know but google custom hz settings for games not being applied and be aggravated.

I'm just trying to narrow down the problem. I'm not sure if it's a direct 3D issue because I've been reading up and I've found a few things relating to this that seem to suggest this. However, there may be work arounds for these kinda things. But because your setup is quite odd it's hard to figure out what part of your setup is causing the problem. We need to isolate the cause then I can look into fixing it. It just seems odd to me that with v-sync off it still happens. That's what's throwing me off right now as that don't make any sense to me.
